Seems like the article is misleading and it regards copyrighted material. That means that It's just like in Sweden right now.

Distribution of films legally and of FreeBSD and of Linux by Bittorrent is P2P distrubution of Copyright protected material. One just is given permission by the copyright holders to do so.
Spain cannot have it both ways.
This is complete BULLSHIT and is total discrimination against small media copyright holders who rely on P2P for distribution.
But of course, that's what *AA was after all along.
