International rap star Eminem has been given the US court's go-ahead to continue his suit against Apple, its advertising agency TBWA/Chiat/Day and MTV.
Though some claims in the case were disallowed the artist can press on with the suit, which alleges the defendants broke federal copyright law and falsely implied the artist had endorsed Apple's iTunes Music Store and iPod.
An MTV Apple TV advertisement in the US had featured a ten-year old singing Eminem's track, Lose Yourself. Two claims of unfair competition and unjust enrichment were rejected, reports the Detroit News. The ad was screened for three months beginning July 2003, and was also made available on Apple's Web site.

If Apple has infringed Eminem's copyright, then they must assume the consequences.

I can understand it somehow. You did your best to make a "don't-fuck-with-me" song, and some dumbass 10-year old fucks it up. I would sue their pants off too.

This case may be more reasonable. It just reminds me of when Metallica sued some canadian band for using a "cord progression" or whatever that Metallica said was theirs. "It is they way the canadain band uses it" says Metallica. I do not know the outcome of the whole thing, but I hope the law suit did not work out for Metallica.

Apple should have just gotten permission to use the song. They are at fault.

Actually the advertising agency was told not to use the song but used it anyway!
Apple is not at fault with this case - it is the advertising agency's fault.
Apple should sue the ad agency or the agency should pay eminem if he wins the case.
The ironic this about this, is that the opening scene in Eminen's new video for his latest single he is seen lying on a bed holding and listening to a silver IPOD MINI!

I think people are missing the bigger picture here. The focus of attention shouldn't be so much about what Apple did, but why a 10 year old listens to Eminem's crap.

Yeah...but why use Eminem? His music is so violent and imature! I don't think he should be even on the market..atought youngsters do like his music! But Why not use Black Eyed Peas? or Maksim or some one else???
